2. Service Description

Sitemap.ai provides an automated sitemap generation service that allows you to create XML, HTML, CSV, and JSON sitemaps for your websites. Our Service includes:

• Automated website crawling and URL discovery (up to 1,000 URLs for free accounts)
• Sitemap generation in multiple formats
• Ability to save and manage crawls (for registered users)
• One-click re-crawling of saved sitemaps
• Export and download functionality

The Service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.

3. User Accounts and Registration

While basic sitemap generation is available without registration, certain features require creating an account:

Account Requirements:

• You must be at least 18 years old to create an account
• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

4. Acceptable Use Policy

Prohibited Crawling Activities:

• Crawl websites without authorization from the website owner
• Violate any website's terms of service or robots.txt directives
• Crawl at rates that could harm or overload target websites
• Access private, password-protected, or non-public areas of websites without permission
• Collect personally identifiable information (PII) without proper authorization and compliance with privacy laws
• Use the Service to scrape content for competitive intelligence, data aggregation, or resale

Prohibited System Activities:

• Attempt to gain unauthorized access to our systems, servers, or networks
• Interfere with or disrupt the Service or servers hosting the Service
• Use automated systems (bots, scrapers) to access the Service in ways that send more requests than a human could reasonably produce
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Circumvent any usage limits, access controls, or security measures
• Resell, redistribute, or provide commercial access to the Service without our written permission

Prohibited Content:

• Sitemap files you generate using our Service
• Your account data and analytics

License Grant:

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business or personal purposes. This license terminates upon termination of your account or these Terms.

You grant us a limited license to process, store, and display your data solely as necessary to provide the Service to you. This license terminates when you delete your data or close your account.

6. Free Service and Usage Limits

Sitemap.ai offers a free tier with the following limits:

• Maximum 1,000 URLs per sitemap
• Limited number of saved crawls for registered users
• Rate limiting to ensure fair usage and system stability

We reserve the right to modify usage limits, implement new limits, or introduce paid tiers at any time. Existing users will be notified of material changes to free tier limits.

Excessive usage that impacts service performance or availability for other users may result in rate limiting, temporary suspension, or account termination.

7. Data Collection and Privacy

Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Important: When you use our Service to crawl websites, any data collected belongs to you. However, you are responsible for ensuring your collection and use of that data complies with all applicable privacy laws (including GDPR, CCPA, and other regulations).

8. Disclaimer of Warranties

We specifically disclaim any warranty that:

• The Service will meet your specific requirements or expectations
• Sitemaps generated will improve your SEO or search engine rankings
• The Service will be available at all times without interruption
• Crawling results will be complete, accurate, or up-to-date
• Errors or defects in the Service will be corrected
• The Service will be compatible with any particular website or CMS platform

You acknowledge that the Service may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control.

9. Limitation of Liability

Our total liability to you for all claims arising from or relating to the Service shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) $100 USD.

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages, and even if any remedy fails of its essential purpose.

• Your crawling activities, including unauthorized crawling or violation of robots.txt directives
• Your violation of any applicable laws or regulations
• Any content or data you submit, process, or collect using the Service
• Your negligence or willful misconduct

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

11. Termination

Termination by You: You may stop using the Service at any time. If you have an account, you may delete it from your account settings.

Termination by Us: We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Excessive usage that impacts service performance
• Failure to pay applicable fees (if paid services are added in the future)
• Legal or regulatory requirements
• Discontinuation of the Service

Upon termination:

• Saved crawl data may be deleted after a reasonable grace period
• Provisions that by their nature should survive termination shall survive (including indemnification, warranty disclaimers, and limitations of liability)

12. Modifications to Service and Terms

Service Changes: We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Terms Changes: We may modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Provide notice through the Service or via email for registered users
• Allow a reasonable period for you to review the changes

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you disagree with the changes, you must stop using the Service.

Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

Force Majeure: We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

Third-Party Rights: These Terms do not create any third-party beneficiary rights.

Export Control: The Service may be subject to U.S. export control laws and regulations. You agree to comply with all applicable export and re-export control laws and regulations.
